1. Introduction

These Terms and Conditions ("Terms") govern access to and use of Tutor Quests™ ("Tutor Quests", "we", "our", "us"), an online educational platform owned and operated by You Edu. Ltd, a company registered in Hong Kong under Business Registration Number 77069584.

By accessing, subscribing to, purchasing, downloading, viewing, or using any materials, content, products, services, website, applications, worksheets, assessments, revision materials, printable resources, video content, digital content, learning activities, or other educational resources provided by Tutor Quests, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must immediately cease using Tutor Quests and all associated materials and services.

 

2. Definitions

For the purposes of these Terms:

Account means any registered user profile created on the Tutor Quests platform.

Content means all educational materials including worksheets, exercises, quizzes, assessments, lesson plans, revision materials, videos, graphics, images, text, downloads, software, websites, and associated materials.

Parent/Guardian means a person over the age of 18 with legal parental responsibility for a Child User.

Child User means a student using Tutor Quests.

User means any individual, parent, guardian, teacher, school, educational centre, tutor, business, organisation, entity, subscriber, purchaser, or visitor accessing Tutor Quests.

Commercial Use means any use connected to a business, school, tutoring service, learning centre, educational institution, franchise, organisation, company, charity, or revenue-generating activity.

Subscription means any paid or free membership, access plan, licence, or package offered by Tutor Quests.

 

3. Eligibility and Age Guidelines

3.1 Intended Age Range

Tutor Quests is designed for children aged 4 to 14 years, covering educational content primarily aligned with Primary School Grades 1–6.

3.2 Adult Supervision

Children must use Tutor Quests under the supervision of a parent, guardian, teacher, or other responsible adult.

Tutor Quests does not knowingly enter into contracts directly with minors.

Any purchase, subscription, registration, or consent provided must be completed by a parent, guardian, or legally authorised adult.

3.3 Responsibility of Parents and Guardians

Parents and guardians are responsible for:

  • Monitoring children's use of the platform.
  • Ensuring age-appropriate use.
  • Supervising internet access.
  • Maintaining account security.
  • Reviewing communications sent by Tutor Quests.

 

4. Educational Purpose Only

Tutor Quests provides educational revision materials for learning support purposes only.

Tutor Quests:

  • Does not guarantee academic performance.
  • Does not guarantee school admission.
  • Does not guarantee examination outcomes.
  • Does not provide professional educational, psychological, medical, legal, or counselling advice.
  • Is not a replacement for physical, full-time education.

Individual learning outcomes may vary.

 

5. Intellectual Property Rights

5.1 Ownership

All intellectual property rights in Tutor Quests and its Content are and remain the exclusive property of:

including all:

  • Copyrights
  • Trademarks
  • Trade names
  • Logos
  • Branding
  • Worksheets
  • Educational methodologies
  • Databases
  • Designs
  • Graphics
  • Software
  • Templates
  • Videos
  • Printed materials
  • Downloadable materials
  • Assessments
  • Question banks

whether registered or unregistered.

All rights are reserved.

5.2 No Transfer of Ownership

Purchase of a subscription or product grants only a limited, revocable, non-exclusive licence to use the materials.

No ownership rights are transferred.

 

6. Permitted Personal Use

Subject to compliance with these Terms, users may:

  • Access purchased materials.
  • Download materials for personal household use.
  • Print materials for use within the subscriber's home.
  • Use materials for educational purposes within their immediate family.

 

7. Prohibited Uses

Users may not:

  • Copy materials for others.
  • Share subscription accounts.
  • Upload materials to websites.
  • Upload materials to social media.
  • Upload materials to file-sharing platforms.
  • Sell materials.
  • Resell materials.
  • Modify materials for redistribution.
  • Remove copyright notices.
  • Create derivative products for sale.
  • Reverse engineer any software components.
  • Use automated scraping tools.
  • Archive entire sections of the platform.
  • Reproduce substantial portions of the Content.

 

8. Restrictions on School, Centre, Tutor and Business Use

8.1 No Institutional Use Without Permission

Unless expressly authorised in writing by Tutor Quests:

The following may not use Tutor Quests materials:

  • Schools
  • Learning centres
  • Tuition centres
  • Tutors operating commercially
  • Franchises
  • Educational businesses
  • Childcare centres
  • Kindergartens
  • NGOs
  • Companies
  • Government departments
  • Training providers
  • Other institutions

8.2 Institutional Licensing Requirement

Organisations wishing to use Tutor Quests materials must obtain a separate commercial licence or institutional subscription.

8.3 Unauthorised Commercial Use

Where Tutor Quests materials are used commercially without permission, Tutor Quests reserves the right to require payment calculated on:

  • The total number of students enrolled;
  • The total number of students who accessed the materials; or
  • The institution-wide licensing rate determined by Tutor Quests;

whichever amount is greater.

The user agrees that unauthorised institutional use may result in:

  • Immediate account termination;
  • Recovery of unpaid licence fees;
  • Legal action;
  • Injunctive relief;
  • Recovery of legal costs;
  • Damages for copyright infringement.

 

9. Copyright Enforcement

Tutor Quests actively monitors unauthorised distribution.

We reserve the right to investigate:

  • Illegal sharing
  • Copyright infringement
  • Subscription abuse
  • Commercial misuse

We may pursue all remedies available under Hong Kong law and international copyright laws.

 

10. User Accounts

Users are responsible for:

  • Maintaining account confidentiality.
  • Protecting passwords.
  • Restricting access to devices.
  • Ensuring information provided is accurate.

Users remain responsible for all activity conducted through their account.

 

11. Payment and Subscription Terms

11.1 Fees

All pricing is displayed in the applicable currency at checkout.

11.2 Subscription Changes

Tutor Quests may modify:

  • Pricing
  • Features
  • Subscription structures

with reasonable notice.

11.3 Failed Payments

Failure to make payment may result in:

  • Suspension of service;
  • Restriction of access;
  • Termination of subscriptions.

 

12. No Refunds

Except where required by applicable law, all purchases, subscriptions, digital downloads, and digital content sales are final and non-refundable once access has been granted.

Tutor Quests may provide refunds at its sole discretion.

 

13. Communications and Marketing Consent

By registering, purchasing, subscribing, downloading resources, entering competitions, or contacting Tutor Quests, users consent to receiving communications including:

  • Service announcements
  • Account notifications
  • Educational updates
  • Product updates
  • Newsletters
  • Promotions
  • Marketing communications

Users may opt out of marketing communications at any time by:

  • Clicking the unsubscribe link;
  • Updating account preferences; or
  • Contacting Tutor Quests directly.

Opting out of marketing communications does not affect essential service notices.

 

14. Privacy

Personal data is handled in accordance with our Privacy Policy and applicable Hong Kong data protection laws.

Users agree to the collection, storage, processing, and use of personal information necessary to provide Tutor Quests services.

 

15. Availability of Services

Tutor Quests does not guarantee that:

  • Services will be uninterrupted.
  • Services will be error-free.
  • Services will be free from bugs.
  • Content will always be available.

Tutor Quests may modify, suspend, remove, or discontinue features without liability.

 

16. Disclaimer of Warranties

Services and materials are provided on an:

"As Is" and "As Available"

basis.

To the maximum extent permitted by law, Tutor Quests disclaims all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Availability

 

17. Limitation of Liability

To the fullest extent permitted by law:

Tutor Quests, You Edu. Ltd, its directors, officers, employees, contractors, affiliates, agents, licensors, and representatives shall not be liable for:

  • Loss of profits;
  • Loss of business;
  • Academic outcomes;
  • Data loss;
  • Indirect losses;
  • Consequential losses;
  • Special damages;
  • Incidental damages.

Total liability shall not exceed the amount paid by the user during the preceding twelve (12) months.

 

18. Indemnity

Users agree to indemnify and hold harmless Tutor Quests and You Edu. Ltd from claims, liabilities, losses, damages, costs, and expenses arising from:

  • Breach of these Terms;
  • Copyright infringement;
  • Unauthorised sharing;
  • Commercial misuse;
  • Violation of law;
  • Misuse of the platform.

 

19. Suspension and Termination

Tutor Quests may suspend or terminate access immediately where:

  • These Terms are breached;
  • Unauthorised sharing occurs;
  • Fraud is suspected;
  • Commercial misuse is detected;
  • Copyright infringement occurs.

No refund shall be payable following termination resulting from breach.

 

20. Force Majeure

Tutor Quests shall not be liable for delays or failures caused by events beyond reasonable control including:

  • Natural disasters
  • Internet outages
  • Cyber-attacks
  • Government actions
  • Pandemics
  • Power failures
  • Third-party service disruptions

 

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

 

22. Jurisdiction

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

 

23. Amendment of Terms

Tutor Quests may amend these Terms at any time.

Updated Terms become effective upon publication on the Tutor Quests website.

Continued use of the platform constitutes acceptance of the updated Terms.

 

24. Severability

If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall continue in full force and effect.

 

25. Entire Agreement

These Terms, together with the Privacy Policy and any subscription agreements, constitute the entire agreement between the user and Tutor Quests.

Important Notice
